Acceptable Use Policy
We build and run a network we're proud of. This policy exists to protect it, and everyone on it, from abuse. It's pretty straightforward: don't be a jerk, don't break the law, and don't mess things up for other customers.
What you can't do
You must not use our network or services to:
- Break any Australian law (or help someone else break one)
- Send spam or bulk unsolicited messages (this also breaches the Spam Act 2003)
- Attempt to hack, compromise, or gain unauthorised access to any system
- Launch or participate in denial-of-service attacks
- Distribute malware, viruses, or other malicious software
- Host or distribute child exploitation material
- Infringe on copyright or intellectual property rights
- Interfere with or degrade other customers' service
- Scan, probe, or attack our network infrastructure or other networks
- Use the service to send threats, harassment, or abuse
- Resell the service without our written agreement
Network management
We manage our network to ensure everyone gets a fair go. Here's what that means in practice:
- Traffic shaping: We may use traffic shaping or policers as described in your plan. You can configure these yourself in the portal.
- No content filtering: We don't filter, throttle, or prioritise traffic based on content type, protocol, or destination, unless required by law.
- Fair use: All our plans are genuinely unlimited. We don't have hidden fair-use caps. If you're using your 250Mbps plan at 250Mbps around the clock, good for you.
- CVC management: We actively monitor and upgrade CVC capacity. We aim to keep utilisation below 80% at all times, including during busy periods.
Copyright
Under the Copyright Act 1968, we have obligations regarding copyright infringement on our network. If a rights holder notifies us of alleged infringement, we may forward their notice to you. We maintain a repeat infringer policy. Customers who repeatedly and clearly infringe copyright may have their service terminated.
Law enforcement
We cooperate with Australian law enforcement agencies when legally required to do so, for example when presented with a valid warrant or authorisation under the Telecommunications (Interception and Access) Act 1979. We don't voluntarily hand over customer data without a legal basis.
What happens if you breach this policy
If we believe you've breached this policy, we'll generally:
- Contact you and let you know what the issue is
- Give you a reasonable opportunity to fix it
- Suspend your service if the issue is serious or ongoing
- Terminate your service for severe or repeated breaches
For serious breaches that threaten network security or involve illegal activity, we may suspend first and talk later. We'll always be reasonable, but we won't compromise the network for everyone else.
